JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending her arrest in a case registered under Sections 420, 467, 468, 471 and 504 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner took Rs.2 lacs from the informant in the name of purchasing some land.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a lady. The husband of the petitioner has already been granted bail with the condition to return the money.

No.51611 of 2016 (2) dt.05-12-2016 2/2 The said money is being returned as per the direction made by the co-ordinate Bench of this Court vide Annexure-2 to the present application. The matter relates to civil dispute. On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. case No.62 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
