Mr.Akshay Lal Pandit, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Rajnagar P.S. Case No. 170 of 2022 for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got three criminal antecedents and he is in custody since 29.07.2022.

It is alleged that informant has suspicion that unknown thieves have stolen bike of the informant. The petitioner has been dragged in the present case merely on suspicion and there is no recovery of bike in question from the possession of petitioner.

Considering the period of custody, the petitioner,

Patna High Court CR. MISC. No.28661 of 2023(2) dt.24-05-2023 2/2 named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1st Class, Madhubani in connection with Rajnagar P.S. Case No. 170 of 2022.

The petitioner will visit Khajauli Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
