1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 427, 354, 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner assaulted him by khanti causing injury on his head.

4. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is next submitted that even presuming what has been alleged is true without admitting then the injury suffered by the injured is

Patna High Court CR. MISC. No.28541 of 2023(2) dt.25-07-2023 2/2 simple in nature, as would be evident from injury report, as Annexure-2 to the anticipatory bail application, it is next submitted that the blow was not repeated on account of dispute relating to land.

5. Learned A.P.P. opposes the bail application.

6. Consideration the fact that the petitioner is a person with clean antecedent and the injury suffered by the informant is simple in nature, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below withing a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Muffasil P.S. Case No. 459 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The applications stands allowed.
