This application, for grant of anticipatory bail, arises out of Konch P.S. Case No. 226 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 506 and 171(c) of the Indian Penal Code. Allegation against the petitioners is of
Patna High Court Cr.Misc. No.42070 of 2016 (2) dt.30-09-2016 2/3 assaulting the informant by means of Lathi and Danda. It appears from the First Information Report that some dispute, in relation to PACS election, and similar matter is the reason behind registration of the First Information Report.
Learned counsel for the petitioners has submitted that the petitioners have no criminal antecedent, as stated in paragraph 3 of the application, and the injuries found to have been simple in nature. Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Konch P.S. Case No. 226 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before
Patna High Court Cr.Misc. No.42070 of 2016 (2) dt.30-09-2016 3/3 the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
