JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-05-2018 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. The petitioners seek anticipatory bail in connection with Pupri P.S. Case No. 450 of 2017 registered for the offences punishable under sections 420, 406, 504, 506/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that after receipt of consideration amount, the land was already registered in favour of the father of the informant by Md. Safiulla Khan, the maternal uncle of petitioner no. 2 on 04.07.2017 and concealing the aforesaid fact, the present case has been mischievously registered against the petitioner to exploit and

On the other hand, learned counsel for the State and learned counsel for the informant has submitted that after receiving a total amount of Rs. 7,40,000/-, petitioners refused to execute the sale deed.

Considering the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No. 450 of 2017, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
