2. The petitioners have preferred this application for grant of regular bail in connection with Darbhanga Sadar P.S. Case No. 415 of 2024 registered for the offences punishable under Sections 310(2) of the BNS 2023, Section 3/4 of the Explosive Substance Act and Section 27 of Arms Act.
3. As per the prosecution story, the informant has alleged that on 03.12.2024 around 11:40 PM, 8-10 armed criminals entered in his house while his family members were sleeping. They held them at gunpoint, locked inside, and looted approximately 20 tolas of gold, 400 grams of silver jewellery,
Patna High Court CR. MISC. No.34534 of 2025(3) dt.01-09-2025 2/3 and Rs. 40,000/- cash. When his neighbour Mohd. Bashir protested, they threw a bomb, injuring him. Villagers gathered, and the police arrived, but the criminals escaped in the darkness.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence rather they have falsely been implicated in the present case. The petitioners are not named in the F.I.R. In the present case, the petitioners have been taken into remand from Jale P.S. Case No. 222 of 2024. It is further submitted that the S.H.O. of Sadar P.S. received information from the S.H.O. of Jale P.S. that some accused persons who have been apprehended in Jale P.S. Case No. 222 of 2024 have disclosed that they have committed the crime/robbery in village-Belhi under Sadar P.S. The petitioners are languishing in custody since 07.12.2024. It is also submitted that no looted articles have been recovered either from the conscious possession or from their house and they were never subjected to any Test Identification Parade (T.I.P.).
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.
6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioners, above named, be released on bail after framing of charge on furnishing bail

No.34534 of 2025(3) dt.01-09-2025 3/3 bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S.
