The petitioner apprehends his arrest in Pirbahore P.S. Case No. 145 of 2020, registered for the offences punishable under Sections 342, 376, 506, 504/506 of the Indian Penal Code and sections 3, 4, 5 and 6 of the Immoral Traffic Act. Prosecution case in brief is that informant became friend of co-accused Soni Khan who sent her to work as household help to the house of petitioner. Petitioner is alleged to have forcibly established physical relation with her. Petitioner also compelled her to have physical relation with other persons. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case. No medical examination has been conducted. Petitioner has got no criminal antecedent. Learned APP vehemently opposed the prayer for bail and submitted that there is specific allegation of committing rape on the informant.
Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
