JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned counsel for the opposite party.

The petitioner alleges wilful disregard/ disobedience of the order dated 16.05.2014 passed in C.W.J.C.No. 6938 of 2014 (Aannexure-1) at the hands of the opposite party. The writ petition was disposed of directing the petitioner to approach the Confiscating Authority and request for expeditious disposal of the proceeding or the application filed therein seeking provisional release of the three vehicles.

A show cause has been filed on behalf of the opposite party.

From Annexure 3 appended to the present contempt

Patna High Court MJC No.3163 of 2014 (2) dt.13-05-2015 2/2 application it appears that the Confiscating Authority has already disposed of pending proceeding in Case No. 18 of 2014 on 25.06.2014.

In my view, the order passed by this Court has substantially been complied with.

In view of the aforesaid, this contempt application has no merit and it is accordingly dismissed.

If the petitioner is aggrieved by order dated 25.06.2014, (Annexure 3) he shall not be precluded from assailing the said order before an appropriate authority/ forum, in accordance with law.
