The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code As per the prosecution case, when the informant was returning after withdrawing cash to the tune of Rs. 7 lacs from the bank, it is stated that the accused persons robbed him of the bag containing cash.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. Referring to the order of the learned trial Court it is submitted that the name of the petitioner transpired in course of investigation in the confessional statement of co-accused Md. Naimuddin made before police which is inadmissible. The said co-accused Md.

Patna High Court CR. MISC. No.37609 of 2021(2) dt.07-01-2022 2/2 Naimuddin has himself been enlarged on bail vide order dated 22.9.2020 passed in Cr. Misc. no. 22618 of 2020. Inspite of being in custody since 8.3.2021 and charge sheet having been submitted in the case, the petitioner has not been put on T.I. Parade.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been put on T.I. Parade, charge sheet having been submitted in the case and grant of bail to the above named coaccused on whose confessional statement the name of the petitioner transpired, the Court directs the petitioner to be enlarged on bail in connection with Amdabad P.S. Case no. 19 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar.
