2. The petitioners are custody in a case registered for the offence punishable under Sections 341, 342, 323, 326, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the
Patna High Court CR. MISC. No.33090 of 2024(3) dt.31-07-2024 2/3 Arms Act.
3. As per allegation in the FIR, the son of the informant was returning home when accused persons shot fired on the back of the son of the informant due to which his son received serious injuries.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that the entire allegation levelled against the petitioners is out of personal enmity and the mother of the petitioners had lodged complaint case no.389 of 2014 and Desari (Sahdei O.P.) P.S. Case No. 355 of 2020 against the son of the informant due to which the petitioners have been dragged in this case without any specific allegation. He next submits that the specific allegation of firing is attributed against co-accused Laxman Sharma and not against these petitioners. Petitioners are in custody since 22.12.2023 and 06.12.2023 respectively.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. Considering the aforesaid facts and circumstances of the case, there is no specific allegation against both the petitioners and period of custody of the petitioners, let the above named petitioners be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.33090 of 2024(3) dt.31-07-2024 3/3 Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Vaishali at Hajipur in connection with Desari (Sahdei O.P.) P.S. Case No. 135 of 2022, subject to the conditions as laid under Section 437
(3) of the Cr.P.C.
