JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Bhagwan Bazar P.S. Case No. 179 of 2015 registered under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.
It is contended that similarly circumstanced eight accused persons, namely, Md. Shiboo @ Shiboo Ali, Md. Lamboo @ Lamboo, Sughan Ali, Md. Bhola @ Bhola, Tiger Ali, Md. Niyazuddin @ Niyazuddin, Md. Mithoo @ Mithoo and Md. Murad Ali @ Murad Ali have already been granted anticipatory bail by a coordinate Bench of this Court by order dated
Patna High Court Cr.Misc. No.293 of 2016 (2) dt.11-01-2016 2/2 14.10.2015 passed in Cr.Misc. No. 45493 of 2015. Learned counsel for the State concedes that the case of the petitioners stands on identical footing to that of other coaccused named above who have already been granted anticipatory bail by a Bench of this Court.
Regard being had to the reasons assigned in the aforesaid order dated 14.10.2015, in the event of arrest or surrender before the court below within six weeks from today, the petitioners, namely, Md. Parleji @ Imteyaz Ali and Suipan Ali Mian @ Md. Supan Ali are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chapra in connection with Bhagwan Bazar P.S. Case No. 179 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
