JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-01-2021 Heard Mr. Kamlesh Kumar Pathak, learned counsel for the petitioner; Mr. Harish Kumar, learned counsel for the informant; and Mr. Ram Priya Sharan Singh, learned APP for the State.
The petitioner seeks bail in anticipation of his arrest in connection with Manihari P. S. Case No. 124 of 2020 dated 15.05.2020, instituted for the offences under Sections 452, 341, 323, 324, 354, 504, 506, 307 and 34 of the Indian Penal Code.
Though the petitioner is alleged to have assaulted the son of the informant by means of a dagger
Patna High Court CR. MISC. No.28237 of 2020(3) dt.08-01-2021 2/2 but the injuries suffered by him is stated to be simple in nature. There are other mitigating factors also which have been narrated during the course of the argument. However, regard being had to the fact that there is a specific accusation of assault by means of dagger with corresponding injuries even though simple, I am not inclined to grant anticipatory bail to the petitioner.
The anticipatory bail petition is rejected.
However, if the petitioner surrenders before the court below and seeks bail, the court below shall take into account that there is a dispute between the family and that the injuries suffered by the victim is simple in nature and shall pass order in accordance with law, without being prejudiced by the fact that the present petition has not been entertained by this Court.
