JUSTICE ALOK KUMAR SINHA ORAL ORDER 30-06-2026 Heard learned counsel for the petitioners, learned counsel appearing for respondent-Lalit Narayan Mishra University, Kameshwar Nagar Darbhanga and learned counsel appearing for the respondent-State.
2. With the consent of both the parties, this writ application is being disposed of at this stage itself.
3. In the present writ application, the petitioner has prayed for the grant of following reliefs:
"(i) For a direction to the Respondent State of Bihar to release the necessary fund/grants to the Respondent Lalit Narayan Mithila University for the payment of current salary and arrears of salary to the petitioners from the date of their regularization or date of initial entitlement to mention the priority among the employees in view of the Article 14 & 16 of the Constitution of India.
(ii) For a direction to the respondent State of bihar to release the Fund/grant to Mithila university Darbhanga for the payment of arrears of dues of the petitioners (Teachers) of G.K.P.D College Karpoorigram from the academic Session 2014-17 to onwards academic Session on the basis of the number of graduate students without any new bindings of 1.5 Crore per academic Session of Affiliated College.
(iii) Direct the Respondent to grant all consequential benefits, including increments and
4/5 allowances, applicable to the petitioner under the 2008 Resolution and the Bihar State universities (Amendment) act, 2015/2017 by loosening the bond of 1.5 Crore rupees each Session.
(iv) Direct the committee constituted vide Memo no. 2829 dated 30.09.2025 to immediately resolve the discrepancy regarding the petitioners salary payment within a fixed time frame.
(v) Pass any other order or direction that this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

After advancing some argument, learned counsel for the petitioners submit that for seeking the aforesaid reliefs, the petitioners are ready to file a fresh representation before the Additional Chief Secretary, Higher Education Department, Government of Bihar, Patna. He further prays that an appropriate direction be issued to the Additional Chief Secretary, Higher Education Department, Government of Bihar, Patna to dispose of the representation which would be filed by the petitioners, within a fixed time frame, after giving an opportunity of hearing to the petitioners.
5. To the aforesaid submission being made by learned counsel for the petitioners, learned counsel appearing for the respondent-University and learned counsel appearing for the respondent-State do not have any objection.
6. Considering the limited nature of prayer being made by learned counsel for the petitioners, this writ application is disposed of granting liberty to the petitioners to file a common
5/5 representation before the Additional Chief Secretary, Higher Education Department, Government of Bihar, Patna within one month from today. If such a representation is filed, the same shall be heard and disposed of within a further period of six months from the date of filing of the representation, after giving an opportunity of hearing to the petitioners.

Needless to emphasize that the final order which shall be passed by the Additional Chief Secretary, Higher Education Department, Government of Bihar, Patna should be a reasoned and speaking order and in the event of the petitioners being found entitled to the relief which they would be claiming through the representation, the same should be extended to the petitioners within a further period of six months from the date of passing of the final order.
8. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
