JUSTICE SANJAY PRIYA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Adhaura P.S. Case No. 45 of 2017, instituted for the offence under Sections 341, 342 and 302/34 of the Indian Penal Code. There is allegation in the Fard-e-beyan that father of the informant was returning with his grand daughter namely, Niniha, Ramnath Singh called the father of the informant in his house and after confining him inside the house he along with his son Mangaru Singh (petitioner) and other family members assaulted the father of the informant. The girl, namely, Ninihia, arrived in the house of the informant and gave information that accused persons were assaulting her grand-father. Thereafter the informant went to the house of Ram Nath Singh and found his

He peeped inside and saw his father (since deceased) was lying dead in the courtyard. The informant took out the body of his father from the courtyard of the house of Ramnath Singh. Case dairy has been received.
The learned APP has submitted that post-mortem report is available in the case diary wherein multiple injuries were found on the person of the deceased. It has further been submitted that process has already been issued against the petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
