JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Banka P.S. Case No. C-7-18/2015 for the offenses under Sections 47A of the Bihar Prohibition and Excise Act. In the instant case 150 Kg of Java Mahua and 25 liters of country made liquor was recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The seizure was made behind the back of the petitioner. Charge sheet has already been submitted showing the petitioner absconder without following the process of law.

Patna High Court CR. MISC. No.28488 of 2020(2) dt.19-01-2021 2/2 Considering the totality of the fact situation, the court is inclined to grant bail to the petitioner on deposit of Rs. 25,000/- cash. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Banka in connection with Banka P.S. Case No. C-718/2015, subject to deposit of Rs. 25,000/- cash and further subject to the conditions laid down under Section 438(2) Cr.P.C. The deposit of cash of Rs. 25,000/- shall abide by the final outcome of the present criminal case.
