JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioners and the State. The petitioners being the parents, brothers, brother's wife and unmarried sister of the husband of the victim girl are apprehending arrest in a case registered for the offences punishable under Section 498A, 406 and 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after two years of the marriage for non fulfillment of dowry demand.

It is submitted by learned counsel for the petitioners that the victim received accidental burn injury when she was taken to P.M.C.H on 02.02.2014 where she died on 07.02.2014 for which

Patna High Court Cr.Misc. No.100 of 2016 (2) dt.05-01-2016 U.D. Case No. 262 of 2014 was registered in which the son of the informant was a witness and thereafter the complaint case was filed on 19.04.2014 which came to be registered as police case on 06.07.2014. Moreover, the thrust of accusation is against the husband of the victim.

Learned counsel for the informant submits that the victim died on mysterious circumstances but has not denied the fact that his son is the witness to the U.D. case. Considering the delayed lodging of the accusation being general and omnibus against the petitioners and the U.D. case being registered on the day the victim died which bears the signature of the son of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Agiaon (Garhani) P.S. Case No. 72 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ranjan/- U T
