Patna High Court Cr. WJC No.1043 of 2014 (3) dt.20-05-2015 counsel for the State.

This writ petition has been filed for issuance of a writ in the nature of mandamus directing and commanding the respondents to give protection of life and properties to the petitioners.

The matter concerned with land dispute and it is alleged that petitioners have title over the said land, but they are being disturbed by opposite party nos. 8 to 26.

Learned counsel for the petitioners submits that earlier a case under Section 144 Cr.P.C. was going on and lastly a Civil Suit bearing No. 393 of 2014 has been filed. Further grievance of the petitioners is that earlier accused persons cutting crop on the field of the petitioners, but police has not taken any action being in effective in this regard.

This writ petition is disposed of with a direction to the Superintendent of Police, Sitamarhi, if petitioners shall file a petition for proper safety of life and property, then he shall take into consideration the petition for proper safety of life and property of the petitioners.
