The petitioner apprehends his arrest in connection with Bahera P.S. Case No.241 of 2017/G.R. No.274 of 2017 registered under Sections 447, 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.
The accusation is that six persons, named in the F.I.R., including the petitioner variously armed with weapons entered into the courtyard of the informant and started to abuse the informant on the pretext of damaging of their maize crops by him. At that time, this petitioner caused injury at the head of the informant and his daughter through axe.
Patna High Court Cr.Misc. No.56909 of 2017 (2) dt.08-12-2017 2/2 Learned counsel for the petitioner submits that, in fact, the occurrence of "Maar-Peet" took place in between the parties due to damaging of the crop of the petitioner by the informant. Moreover, the injuries as sustained by the informant and his daughter are simple in nature.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Bahera P.S. Case No.241 of 2017/G.R. No.274 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
