The petitioner is apprehending his arrest in connection with Kotwali P.S. Case o. 159 of 2010 registered for the offence punishable under Sections 467, 468, 471, 420 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is an innocent person and merely on the ground that his name was wrongly mentioned in the certificate of matric and intermediate, he has been implicated in this case. However, the informant himself admitted the fact that it is a matter of impersonation and for that the legislation had made Section 419 of
Patna High Court Cr.Misc. No.54396 of 2016 (3) dt.13-01-2017 2/2 the Indian Penal Code, which is bailable in nature, hence the petitioner may be enlarged on bail as he is a student. Considering the facts and circumstances of the case, nature of offence and also that there is specific allegation against the present petitioner, I am not inclined to grant the petitioner, the privilege of anticipatory bail, it is accordingly rejected.
