1. Heard learned counsel for the petitioner and learned Special P.P. for the Vigilance.

2. The Court has perused the order dated 19.07.2017, whereby the complaint case filed by the petitioner has been dismissed by the learned Special Judge, Vigilance, North Bihar, Muzaffarpur on the ground that complaint case has been filed without the sanction order against the proposed accused persons, who are public servants and without sanction order to proceed in the case would be in breach of the judgment of the Hon'ble Supreme Court in the case of Anil Kumar vs. M.K.Aaiyappa, in 2013 (10) SCC 705 and also the order of this Court passed in the case of Sakaldeo Paswan vs. State of Bihar through D.G. Vigilance & Anr., in 2015 (3) PLJR 790. The

Patna High Court CR. MISC. No.49444 of 2017(2) dt.29-11-2023 2/2 Court does not find any infirmity in the order dated 19.07.2017 passed by the learned Special Judge, Vigilance, North Bihar, Muzaffarpur.

3. The quashing application is dismissed.
