JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2023 Petition for pre-arrest bail of petitioner no.2 is dismissed as withdrawn vide order dated 23.6.2023. Heard learned counsel for the petitioner no. 1 and the State.

Petitioner no. 1 apprehends arrest in a case registered for the offence punishable under sections 307/379/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner no.1 assaulted nephew of the informant with iron rod.

Case and counter case. Doctor has found simple injuries. Petitioner claims clean antecedent. Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.28641 of 2023(3) dt.04-07-2023 2/2 bail of the petitioner no. 1 is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no.1, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bettiah, West Champaran in Nautan Jagdishpur Police Station Case No. 525 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
