JUSTICE RAMESH KUMAR DATTA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and learned counsels for the B.N.Mandal University and for the State. The contempt application has been filed claiming wilful disobedience of the order dated 14.8.2012 passed by this Court by which it was directed to ensure that the difference of post retiral dues are paid to the petitioner on the basis of revised pay scale with effect from 1.1.1996 and further the petitioner was directed to file a representation after re-fixation of pension in the pay scale introduced from 1.1.1996 before the respondent authorities of the University for grant of the benefit of 50% D.A. merger with effect from 1.1.2005 as also revision of pension with effect from 1.1.2006 which shall be considered and disposed of keeping in view the various decisions of this Court.

In the show cause filed on behalf of the opposite party Nos. 3 and 4, officials of the B.N.Mandal University, Madhepura, it is stated that the different claims of the petitioner with regard to pension have already been considered and disposed of, in

Patna High Court MJC No.977 of 2013 (8) dt.24-08-2016 support of which detailed statement has been annexed as Annexure-B.

Learned counsel for the petitioner on instructions submits that certain other dues remain to be paid by the opposite parties. In the above circumstances, the contempt application is disposed of with a direction to the opposite parties to consider the other post retiral dues, if any, and pay the same in accordance with law.
