The petitioner who is the nephew of the informant, seeks bail in anticipation of his arrest in connection with Bind P.S. Case No. 146 of 2017 dated 27.12.2017 instituted for the offences under Sections 447, 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code.

The petitioner and others are said to have assaulted the informant and other members of the family. The injuries suffered by the victims are of simple in nature.

Learned counsel for the petitioner however has submitted that because of the property dispute, the petitioner being the nephew of the informant has been

Patna High Court Cr.Misc. No.25390 of 2018(2) dt.03-05-2018 2/2 made accused in the present case. A partition dispute is pending between the parties and that is the main reason for the false implication.

Considering the relationship of the petitioner with the informant and existing land dispute between the parties, this Court is inclined to grant anticipatory bail to the petitioner.

The petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Biharsharif, Nalanda in connection with Bind P.S. Case No. 146 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
