Petitioner is an accused in connection with Behia P.S. Case No. 29 of 2019 for the offence registered under Sections 20 (b) (ii)(B) and 25 of the Narcotic Drugs and Psychotropic Substance Act.

Earlier prayer for bail of the petitioner was rejected vide order dated 07.11.2019 passed in Cr. Misc. No. 64261 of 2019 on merit with an observation that the petitioner may renew his prayer for bail after the framing of charge. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that the charge has already been framed as detailed in paragraph 3 of the bail petition (Annexure 3) and the

Patna High Court CR. MISC. No.28434 of 2020(2) dt.11-11-2020 2/2 petitioner is in custody since 06.02.2019.

Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing personal bail bond to the satisfaction of Session Judge, Bhojpur at Ara in connection with Behia P.S. Case No. 29 of 2019.
