This is a petition for quashing the First Information Report of Shastri Nagar P.S. Case No. 559 of 2013 (Annexure-5) on the ground that the petitioner was not present on the date of occurrence as he was at Calcutta and has taken a plea of alibi.

2nd supplementary counter affidavit has been filed by the State showing that the charge-sheet has not been submitted against the petitioner and he is not sent up for trial and the charge-sheet has been submitted against the co-accused Shailesh Singh and the other co-accused has been shown as absconder.
