JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

Petitioner and other accused persons are alleged to have assaulted the deceased with fists and slaps causing grievous injuries. The deceased was thereafter taken to hospital but on way he died.

Learned counsel for the petitioner submits that the similarly situated co-accused Dhan Singh has already been allowed bail by a co-ordinate bench of this Court vide Annexure 2. There was no intention to kill the deceased as there is only allegation that the accused persons assaulted the deceased with fists and slaps. He is in custody since 1.2.2021.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Gopalganj in Kuchaikot Police Station Case No. 112 of 2020.
