====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 08-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Special Case No.986 of 2020 arising out of Araria P. S. Case No.969 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 25.11.2020, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 576 litres of liquor from a car of Mahindra Company.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.37696 of 2021(2) dt.08-12-2021 2/2 petitioner is alleged to be the driver of the said vehicle. It is further submitted that petitioner was not aware what was being carried in the said vehicle.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 25.11.2020, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise, Araria in connection with Special Case No.986 of 2020 arising out of Araria P. S. Case No.969 of 2020. The application stands allowed.
