====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 09-05-2018 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Dhansoi P.S. Case No.2 of 2018 for the offences registered under Section 341,323,504,506 and 379/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that informant went to his brothers, namely, Dhananjay Singh (petitioner) and Mithlesh Singh to take his share but petitioner, Mithlesh Singh and son of Mithlesh Singh assaulted him and his wife and also snatched a golden locket from his wife's neck.

It has been contended on behalf of the petitioner that petitioner is innocent and a false and fabricated case has been registered against the petitioner. Petitioner and informant are full brothers. No family partition has been held as their father is still alive. No eyewitness is there to the occurrence. Police did not recover any fire arms from the house of the petitioner.
