Mr. Harendra Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2026 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(1), 191(3), 190, 115(1), 109(1), 303(1), 76 and 329(1) of the B.N.S..

As per prosecution case, on 17.03.2025, when the informant was at his home with entire family, in the meantime, all the FIR named accused persons, including these petitioners, variously armed, entered into the house of the informant and assaulted informant and his family members, misbehaved with

Patna High Court CR. MISC. No.28902 of 2026(2) dt.11-05-2026 2/3 the female members of the family and looted mobile and jewelry of Rs. 25,000/-.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, on account of pre-existing land dispute, maar-peet took place between the parties in which both sides sustained injuries. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against these petitioners. Doctor has found the injuries, allegedly caused by these petitioners, simple in nature. Rest of the allegations are ornamental in order to make the case grave. It is further submitted that similarly situated co-accused persons have already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 15.10.2025 passed in Cr. Misc. No. 72292 of 2025. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, case and counter-case, nature of injuries allegedly caused by these

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Lakhisarai in connection with Kajra P.S. Case No. 25 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
