ANJANA MISHRA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Murliganj P.S. Case No. 180 of 2013, registered for offences punishable under Sections 419, 420, 468, 471, 409, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a principal of the School in question and the allegation against him is that he had admitted some students on the basis of forged school leaving certificates submitted by them. It is submitted by the learned counsel for the petitioner that the headmaster has no role to play in issuance of such fake certificates and, therefore, he cannot be penalized for having admitted some

Patna High Court Cr.Misc. No.15395 of 2015 (4) dt.05-01-2016 2/2 students who have somehow procured the said forged school leaving certificates.

Considering the aforementioned facts and circumstances and the nature of allegation made against the petitioner, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 180 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. .
