====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-11-2017 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 504, 420, 406, 468, 354 and 354A/34 of the IPC.
The prosecution case got initiated with the filing of Complaint Case No. 806 of 2017, which ultimately got registered as Dariapur P.S. Case No. 165 of 2017, after being transferred under Section 156(3) of the Cr. P.C. The prosecution case is that the informant purchased 7 Katha 16 Dhurs of land appertaining to part of Khata No. 72, Plot Nos. 209 and 210 from the accused persons. The sale deed dated 05.08.2014 reflects that the sale deed was executed by the petitioner, coaccused Jagat Mahto and Lakshminia Devi. Co-accused, Jagat Mahto and Lakshminia Devi have been granted anticipatory bail
Patna High Court Cr.Misc. No.51490 of 2017(4) dt.13-11-2017 2/2 by the learned Additional Sessions Judge by the impugned order itself, wrongly assuming that the sale deed was executed by the petitioner. The sale deed was executed in the year 2014, but the complaint case was filed in the year 2017.
Considering the nature of accusation and the fact that similarly situated accused persons have been granted anticipatory bail by the learned Court below itself, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-IV, Saran at Chapra in connection with Dariapur P.S. Case No. 165 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
