JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-01-2022 Heard Mr. Amit Kumar Anand, learned counsel for the petitioner and Mr. Bharat Bhushan, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Special Excise Case No. 5011/2020 arising out of Barh PS Case No. 323/2020 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act 2016. The police intercepted a pickup van bearing Registration No.BR01GF/3487 and recovered 816 litres of country made illicit liquor and 14.250 litres of foreign liquor from the said van. Name of the petitioner has been disclosed by the arrested co-accused persons.

Learned counsel for the petitioner submits that the petitioner is neither the driver nor the owner of the said vehicle

Patna High Court CR. MISC. No.38071 of 2021(2) dt.07-01-2022 2/2 and no illicit liquor has been recovered from his conscious possession or from the vehicle belonging to the petitioner. Learned counsel further submits that his name was disclosed by arrested co-accused persons and he is in custody since 09.02.2021 and the charge-sheet has been submitted. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that no illicit liquor has been recovered from his conscious possession or from the vehicle belonging to the petitioner, he is in custody since 09.02.2021 and the charge-sheet has been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, VEENA YADAV @ BINA KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Excise Case No. 5011/2020 arising out of Barh PS Case No. 323/2020.
