The petitioner apprehends his arrest in (Nawada) Muffasil P.S. Case No. 104/2016, registered for the offences punishable under Sections 341, 323, 354, 354B, 427, 379, 504, 506, 386 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that the petitioner and others having armed with different weapons including fire-arm came to the land and assaulted the informant. It is further alleged that when his wife and son came to save him, Sarju Singh (petitioner) and Ramashray Singh caught his wife and stripped her clothes. They also demanded extortion of Rs. 50,000/-.

It is submitted that the petitioner was armed with fire-

Patna High Court Cr.Misc. No.45986 of 2016 (2) dt.28-11-2016 2/2 arm, but no firing was made. Petitioner is the purchaser of 1/3rd of land from co-sharer of the informant and on account of land dispute the informant filed this case.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that there is land dispute between the parties, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with (Nawada) Muffasil P.S. Case No. 104/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
