In this case, the petitioner is seeking anticipatory bail in connection with Hajipur Sadar P.S. Case No.52 of 2017, registered for the offence punishable under Sections 307, 379 and 323/34 of the Indian Penal Code and under Section 27 of the Arms Act.
The petitioner and informant are close relatives. There is direct allegation against the petitioner to have caused fire arm injury to the informant. The reason behind the incident is that the petitioner was putting pressure upon the informant to withdraw the civil suit filed by him, when he refused this offence has been committed by the petitioner.

No.40749 of 2017 (2) dt.21-09-2017 2/2 Learned counsel for the petitioner has taken a defence that the doctor has seen the petitioner at 9:10 pm. whereas the incident has taken place at 9:15 pm. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within three weeks from today and prays for bail, the Court below will pass the order in accordance with law without being influenced by the order of this Court.
