The present application under Section 482 of the Code of Criminal Procedure has been filed on behalf of the petitioner for restoration of Cr. Revision No. 679 of 2016 which stood dismissed for non-compliance of the peremptory order dated 18th of July, 2016 passed by this Court.
It is contended by the learned counsel for the petitioner that in order to remove the defects within time, an effort was made by the petitioner but the certified copy of the correct order dated 5.8.2016 could be supplied by the pairwikar of the petitioner on 12.8.2016 and, hence, the same could not be filed before the Court within stipulated period. Patna High Court Cr.Misc. No.38954 of 2016 (2) dt.05-10-2016 2/2 already been filed before the Registry.
Considering the submission made at the Bar, the application is allowed.
