Heard learned counsel for the petitioner and the State. Present revision application is directed against order dated 19.3.2020 passed by the Special Judge (Children Court), Gaya in Criminal Appeal (Juvenile) No. 21 of 2020 (CIS), whereby appeal for grant of bail, preferred by the petitioner, has been dismissed.

Earlier prayer for bail of this petitioner was rejected vide order dated 02.02.2021 passed in Cr. Revision no. 372 of 2020.

By filing the instant petition, petitioner has renewed his prayer for bail on the ground that he is in custody for more than two years and a similarly situated Juvenile co-accused

Patna High Court CR. REV. No. 435 of 2021(5) dt.15-09-2021 2/3 Anup Kumar @ Anup Kumar Yadav has been granted bail by a coordinate bench of this court and father of the petitioner ensures that he is ready to keep the petitioner in his strict supervision and guidance.

Considering the facts and circumstances of the case, this petitioner being minor on the alleged date of occurrence and the maximum period for which he may be kept in the specified Home is three years only, he has already spent for more than two years as also considering that his father is ready to furnish an undertaking that if release on bail the petitioner shall not be allowed to fall in a bad company, this Court set aside the impugned order and directs release of the petitioner above named on furnishing bail bond of Rs 25,000/- with two sureties of the like amount each to the satisfaction of Juvenile Justice Board, Gaya in connection with Guraru P.S. Case no. 91 of 2019.

The father of the petitioner shall file an affidavit giving undertaking that after release of the petitioner on bail he would not be allowed to come in any contact of persons having criminal antecedents.

The Probation Officer attached to the Juvenile Justice Board, Gaya shall keep on visiting the place of petitioner and

Patna High Court CR. REV. No. 435 of 2021(5) dt.15-09-2021 3/3 submit his periodical report to the Juvenile Justice Board, Gaya. With these observations/directions, this revision application is allowed.
