ANJANA MISHRA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Nautan (Jagdishpur) P.S. Case No. 63 of 2016 for the offences registered under Sections 467, 468, 420, 471, 120(B), 272, 273 and 414 of the Indian Penal Code and Section 47(a) of the Excise Act.

Learned counsel for the petitioner submits that though there is allegation of some recovery of alleged liquor from the possession of the petitioner and one Mukesh Patel @ Mukesh Phatel, only one composite seizure list has been prepared and the same does not bear the signature of the present petitioner. It is further submitted that so far as the present petitioner is concerned, nothing was recovered from his conscious

Patna High Court Cr.Misc. No.38052 of 2016 (2) dt.03-10-2016 possession. Furthermore, the other co-accused persons, namely, Mukesh Patel @ Mukesh Phatel has already been extended the privilege of anticipatory bail vide order dated 05.08.2016 passed in Cr. Misc. No. 23607 of 2016.

Considering the aforementioned facts and circumstances of the case and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., VI, Bettiah West Champaran in connection with Nautan (Jagdishpur) P.S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
