JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 This modification application has been filed for modification of order dated 10.10.2018 passed in Cr. Misc. No.54985 of 2018 by which the petitioner has been granted bail. Submission of learned counsel for the petitioner is that he has no knowledge about the criminal antecedent of the petitioner and as such he has mentioned that the petitioner has no criminal antecedent, though he is accused in one more case. Heard learned A.P.P. also.

From perusal of record of Cr. Misc. No. 54985 of 2018 it appears that petitioner has mentioned that he has no criminal antecedent and after considering the same, prayer for bail of the petitioner was allowed, however, now it is mentioned that the petitioner is accused in one more case.

No.24843 of 2019(2) dt.24-04-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case as stated above and also considering the fact that the petitioner is in custody for more than a year, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya, in connection with Raushanganj (Banke Bazar) P.S. Case No. 24 of 2018.

Accordingly, this modification application is allowed. Let a copy of this modified order be communicated to the court concerned at once.
