JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 24.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Khajanchi Hat (Maranga) P.S. Case No. 760 of 2019, registered under Sections 25(1-B)A,26/35 of the Arms Act. The accusation is of recovery of one loaded country made pistol along with five cartridges from the bed of

Patna High Court CR. MISC. No.31726 of 2020(2) dt.04-12-2020 2/2 the house of petitioner on which petitioner along with Sonu Kumar and Dharmendra Kumar were sleeping.

Learned counsel appearing for the petitioner submits that the prayer for bail of the petitioner was refused on 27.02.2020 vide Criminal Miscellaneous No. 3300 of 2020 with liberty to renew his prayer for bail after framing of the charge. The Charge has already been framed against the petitioner and two others on 19.06.2020, which would appear from Annexure-3. The petitioner is in custody since 11.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Smt. Kavita Kumari, Judicial Magistrate, Purnea in connection with Khajanchi Hat (Maranga) P.S. Case No. 760 of 2019. One surety must be parents/close relative of the petitioner.
