JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 04-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Ayar P.S. Case No. 41 of 2017 registered under Section 304B read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is distantly related to the deceased. The mother-in-law and father-in-law of the deceased have already been granted pre-arrest bail by a Bench of this Court vide order dated 01.05.2018 passed in Cr. Misc. No.14777 of

Patna High Court Cr.Misc. No.26393 of 2018 (2) dt.04-05-2018 2018.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. However, he admitted that the case of the petitioner stands on identical footing to that of the other co-accused persons who have already been granted pre-arrest bail by a Bench of this Court. Considering the submissions made on behalf of the parties, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, at Ara in connection with Ayar P.S. Case No. 41 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
