Petitioner seeks regular bail in a case registered for the offence punishable under Section 304B,34 of the Indian Penal Code.
As per the prosecution case, on 15.01.2019 the informant received information that his daughter has been killed by the accused persons, including this petitioner for non fulfillment of demand of dowry.
Petitioner is husband of the deceased and it is submitted that he never demanded any dowry nor tortured the deceased. The deceased was pregnant and at the time of birth of child unfortunately she died. Petitioner is in custody since
Patna High Court CR. MISC. No.37649 of 2021(2) dt.07-01-2022 2/2 21.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is husband and the deceased died at her matrimonial home within seven years of marriage under unnatural circumstances.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
