JUSTICE RAVI RANJAN ORAL ORDER 29-01-2016 Heard learned counsel for the petitioners, the State and the informant.
The petitioners apprehend their arrest in a case filed under Sections 304B/34 of the Indian Penal Code. It is contended on behalf of the petitioners that though accusation is of killing the sister of the informant for nonfulfillment of demand of dowry after four years of marriage, however, the allegation is general and omnibus in nature and petitioners claim to be living separately from the husband of the deceased. In support thereof, Annexure 2 has been appended showing that there was partition in the family and, accordingly, mutation was done in separate name. It is further stated that the

No.58448 of 2015 (2) dt.29-01-2016 2 / 2 petitioner no.1 is the sister-in-law and the petitioner no.2 is the brother-in-law of the deceased, however, mother-in-law and father-in-law of the deceased have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 10.11.2015 passed in Criminal Miscellaneous No.51122 of 2015.
Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Atri P.S. Case No.80/2015, the above named petitioners, Priyanka Kumari and Bittu Singh shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 2nd, Gaya subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
