The petitioners seek pre-arrest bail in connection with Adapur P.S. Case No.34 of 2016 registered under Sections 304-B, 201 read with 34 of the Indian Penal Code.

Considering the submission made on behalf of the petitioners that on completion of investigation the police did not find the case true against them and they were not sent up for trial but the learned Sub Divisional Judicial Magistrate summoned them also differing with the police report and co-accused Bachcha Devi has already been granted pre-arrest bail by a Bench of this

Patna High Court Cr.Misc. No.26504 of 2018 (2) dt.07-05-2018 2/2 Court on 31.08.2016 in Cr. Misc. No.34780 of 2016, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Adapur P.S. Case No.34 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
