JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A of the Indian Penal Code and Section 3 of the Dowry Prohibition Act.

The accusation is of torture for non-fulfilment of the dowry demand.

Learned counsel for the petitioner submits that the petitioner admits his marriage with the complainant and is ready to keep the complainant as wife with full dignity and honour. A statement to that effect has been made in para 12 of the petition which reads as follows:- "That....the petitioner is ready to keep the complainant with good behaviour."

Patna High Court Cr.Misc. No.459 of 2016 (2) dt.11-01-2016 The impugned order suggests that 82 and 83 Cr. P.C. processes have already been issued.

In the circumstances, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 666 of 2011 pending in the court of learned CJM, Aurangabad keeping in view the present stand of the petitioner.

It is expected from the learned court below to dispose of the regular bail application of the petitioner on the same day. Accordingly, the application is disposed of.
