The petitioner is in custody in connection with Ara Rail P.S. Case No. 67 of 2018 for the offences under Sections 147, 148, 149, 307, 506 of the Indian Penal Code and Section 27, 25(1-b)a, 26 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 11.03.2019. He further submits that from the prosecution case it appears that allegation against this petitioner is that petitioner and Radha Mohan Yadav assaulted the informant with knife, Radha Mohan Yadav have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 66759 of 2018 vide order dated 30.11.2018.

No.29248 of 2019(2) dt.02-05-2019 2/2 Considering the fact that petitioner has no criminal antecedent and similarly circumstanced co-accused have been granted bail by co-ordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate, Railway at Ara, Bhojpur in connection with Ara Rail P.S.
