JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-01-2022 Heard Mr. Ajay Kumar Singh, learned counsel for the petitioner and Mr. Manoj Kumar, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Ara Town PS Case No. 251/2020 registered for the offence punishable under Sections 447, 341, 323, 324, 325, 307, 379, 504/34 of the IPC.
Petitioner has, allegedly, assaulted wife of the informant and one Bhola Ram by means of iron-rod on their heads.
Learned counsel for the petitioner submits that both the parties are neighbours having their shops side by side and there is business dispute between them. He next submits that the nature of injuries caused to the wife of informant and Bhola Ram has not been brought on record by the prosecution and

No.38070 of 2021(2) dt.07-01-2022 2/2 there is case and counter case also lodged by the petitioner against the informant and others in which petitioner and others have received injuries which would be evident from Annexure-4 Series. Learned counsel further submits that petitioner is in custody since 03.02.2021 having no criminal antecedents. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that both the parties are neighbours having business dispute between them, there is case and counter case, both sides have received injuries, petitioner is in custody since 03.02.2021 having no criminal antecedents and the charge-sheet has been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, MANOJ RAM @ MANOJ KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town PS Case No. 251/2020.
