The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No.267 of 2017 registered under Section 135 of the Indian Electricity Act, pending in the court of the Special Judge (Electricity), Magadh Area, Gaya.

The accusation against the petitioner is of running the flour mill by putting "TOKA" in L.T. Line causing loss of Rs.3,70,647/- to the Electric Department.

Learned counsel appearing on behalf of the petitioner submits that, in fact, earlier, the petitioner was made accused in similar cases.

Patna High Court Cr.Misc. No.57626 of 2017 (2) dt.18-12-2017 2/2 Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner would be at liberty to approach the appropriate forum under Section 152 of the Indian Electricity Act to compound the case.
