The present writ application has been filed by the petitioner to quash the selection and appointment of respondent No.7 on the post of Aganbari Sevika in Dharhara Anganwari Centre, Ward No.17, Gram Panchayat Akhorhigola, Ward No.17, Block-Akhorhigola, District-Rohtas. The further prayer has been made to initiate fresh selection proceeding for appointment of Anganwari Sevika at Anganbari Kendra Dharhara after revision and correction of mapping pangi.
Patna High Court CWJC No.9405 of 2019(3) dt.03-09-2024 2/2 Further prayer is to consider the selection of petitioner in accordance with new guideline issued by the authorities.
3. Counsel for the State raised preliminary objection and submits that the actual remedy is already available to the petitioner to file Anganwari case before the concerned District Programme Officer.
4. Counsel for the petitioner submits that this writ petition may be disposed off granting opportunity to the petitioner to challenge the appointment of private respondent No.7 before the appropriate forum according to relevant Margdarshika for appointment of Anganwari Sevika or Sahayika.
5. In this view of the matter, the present writ application stands disposed off, directing the petitioner to avail the remedy before original forum under the relevant Margdarshika for appointment of Anganwari Sevika or Sahayika, if cause of action shall arise.
6. With the aforesaid direction, the present writ application is hereby disposed off.
