Petitioner seeks bail in connection Motipur P.S. Case no. 135 of 2021 registered for the offence punishable under sections 30(A), 41(i) and 41(ii) of Bihar Prohibition and Excise Amendment Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.04.2021, is person with clean antecedent and charge sheet has been submitted. Learned counsel submits that from perusal of the allegation as alleged in the FIR, it would manifest that 209 liter liquor was recovered from possession of this petitioner and rest was recovered from other accused. Learned counsel submits that petitioner had gone to his matrimonial home to take his wife and villager falsely

Patna High Court CR. MISC. No.37689 of 2021(2) dt.08-12-2021 2/2 implicated him in the present case.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 22.4.2021, is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in Motipur P.S. Case no. 135 of 2021.
