JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Pakaribarawan P.S. Case No. 107 of 2015, disclosing offences under Sections 341,323,324,307 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits, referring to the First Information Report, that apparently the occurrence is relatable to some land dispute between the parties. He submits that the injuries have been found to be simple in nature. The petitioners are father and son, whereas the informant is the brother of petitioner no.1. He further submits that there is no chance of

Considering the nature of accusation and dispute between the parties which is the genesis of the occurrence, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri N.K. Singh, learned Judicial Magistrate, Ist Class, Nawada in connection with Pakaribarawan P.S. Case No. 107 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to the cancelled.
